Re: New baby and employer terminated me

i think the reason they didn't give you a reason is because if they said were terminating you for absence in your case (you already explained you were taking care of your duties and obligations as a parent) you probably could shoot back... i don't know the laws in your state... during your hiring process they probably made you sign a bunch of legal papers dealing with your probationary period(with lots of fine print and legal jargon)...probably stating they could terminate at will.

this type of behavior is bad with big companies but worse with govt agencies.
this is a sad part of the society we live in. people are unable to feel another person's pain or acknowledge another person's struggle.. if this happened to me i don't think i would appeal. i would probably decide its better i didn't work there..before i left i would get management together and they would hear my final thought.

i don't think upper management would be sitting around thinking about a list of people who missed more than 3 days..i think your immediate supervisor had something to do with getting this started.. regardless the management will always band together and cover each other... before something like this went down they all had to sit down and conspire about how to do this and minimize damage..

good luck on your appeal ... but i hope something comes along and gives you more flexible time off for you to handle important issues with your family.

Re: New baby and employer terminated me

If I had been there a year, I would have FMLA rights to take off 12 weeks. They also fired another genteman in the class who had a baby. Plus, after talking to my union rep, I was told that the department has fired at least two other probationary employees after they came back from medical leaves. My union rep encouraged me to file a discrimination complant withe the state (because this involves my son's medical condition). But that is a long process...my initial appt is not for six weeks. I can also get an attorney and sue, but that is a last resort since it involves me spending money.

I'm still holding out hope that I can get through to someone in a position of authority who will recognize that what they did was wrong. If they can't be convinced to do the right thing, then perhaps I can embarass them by telling my story.

Sorry this happened to you. It can really make a person feel badly. Sounds like you're one of many though, so don't take it personally...although this hardly makes it right.

You'll do what you feel is right and what you need to, but just don't let a long drawn-out fight take the good out of you. So many more positive things to focus on...like your wife and children, who need you. :)

It might be better to just get another job, than to work for a place that cares so little about it's people. You and your family deserve better.

I think something else must be around the corner for you, and as the saying goes, "when one door closes, another one opens". I do think it's right to expose them however, not so much to embarrass them, but to maybe prevent this from happening to others...make people aware.

Sure hope you find an even better job soon. Good luck to you...and congrats on the new baby! I'll be praying with the other members for the good health of your baby son and a great new job soon. ;)

: )

However, our cardiologist is telling us to prepare for surgery within the next 3-6 months.

With all this going on, I started a new job as a Medi-Cal (known as Medicaid in other states) worker. We had to go to 3 appointments per week for my wife and unborn son. While we did our best to schedule appointments, I missed about 1.5-2 hours per week plus a few days when my son was born. I spoke to my supervisors and everyone seemed very understanding. At one point, we were told that management wanted a list of trainees who had more than 3 absences, but I thought I was on solid ground given my situation. Then, two weeks after my son was born, they decided to terminate me. As a probationary employee, their termination letter (which a supervisor read to me) did not list a reason. However, I was the top student in my training class with a 98% average, so it was readily apparent that I was being terminated because of my absences.

I'm trying to get my job back, so far I've written a letter to the person in charge of making the termination decision. If that doesn't work, I'm going to try to get the head of the department involved, then the board of supervisors, and my congressperson. I've tried to get the newspaper to hear my story but they aren't interested unless I file a lawsuit and I am not there yet.

Anyway, I hate to be a downer, but this really has me questioning people's decency. In all my previous jobs, I took maybe 1-2 sick days a year and my wife had to beg me to take vacations. I didn't expect to be treated this way, especially working for a government agency whose sole purpose is to help children and the downtrodden.

Your situation sounds PERFECT for a news story. Sometimes the public pressure (and sympathy) surrounding just such a situation could be quite useful. At other times, just the threat of giving such a story is effective.

What have you got to lose? :lurk:

I would contact your local government agency. There are FMLA LAWS covering leave that employers must follow. The only thing being is that you were under your probationary period. However I would also put letters to the editor in the local paper and throw it out in the community about how this employer has treated you unjustly. I was head union steward for a large company and would not hesitate to file charges against something like this. Even if legally it might not stick just the bad rep might be enough. I had luck with this type of attack against one of the largest clinics in the midwest. Hope it goes well for you.

Tough breaks ... Your pediatrician is probably already on it, but just to make sure: your son's teeth will be at about twice the risk for cavities, so ideally you will get the fluoride doses just right.

(A few quick refs if you want to go deeper yourself - if you balance the nutrients for your bananas you might want to take a look at what is done for preggers and kids. Here is the risk for caries with heart defect: Dental caries experience in children with congenit... [Int J Paediatr Dent. 2004] - PubMed result Here is my own site on infant doses of fluoride - this was one of my favorite subjects about 20 years ago: Infant fluoride and the OptiDoseŽ dropper - by Ray Grogan )

Great Idea,

Get the media involved, or maybe you have a TV programe (consumers affairs style) Here its called 'one Show' Its a programe that talk to people, gain a solution to people's problems.

Did you sign any employment contract if so maybe they broke it.

Here we would take them to a tribuneral.

Whatever you do, get advice.

I am really sorry and will pray for your new baby son to get through with ease the coming surgary. Try not to stress when he does the kids are way stronger than you think.

I got my job back today! Well, it actually isnt official until tomorrow but I got the call today. My county supervisor really went to bat for me. I think the department was embarassed about what happened once elected officials started calling and asking questions. My assemblyman's office also made an inquiry.

I think a personal note of thanks (very profuse thanks!) is in order. Fancy paper, fancy envelope, etc.

Many folks just don't give a rip, so when you find one that does - show genuine appreciation. Maybe a few notes of thanks (and support) to the political types that spoke up, too?

Oh definitely. I will be writing quite a few hand written thank you notes this weekend. I'm exhausted right now...been quite a week, especially the last two days.
