Yes, even a hobbyist is required to comply with Federal and state regulations in the USA to help prevent the spread of insect and disease pests.

Where does one get a nursery license? Do you call your state agriculture department? Do you really need a license if you sell a plant or two a year? Im not on eBay… Yet but I’ve thought about making a little money in my hobby to buy other bananas.

Anyone know if I need one in Canada too if I only sell the odd pup that I have too many of? I'm assuming so but would probably not use eBay, just kijiji (like Craig's list).

In case it's not apparent, Tony's point of posting this article here about Asian Citrus Psyllid is that this pest arrived to California via illegally imported citrus trees and the huanglongbing arrived via illegally imported citrus trees as well (we had ACP here well before a single diseased specimen was found earlier this year). Most nursery citrus trees are already made entirely in screened grow houses ahead of regulations which require this (effective in January 2013, I believe).

Just to be clear, the rules seem to say that "moving" plants requires a permit, but does that refer to selling them or physically moving them? I would think that if every person needed a permit to physically move a plant, no one could buy any plant to transport it home, right?

I mean, I'm supposed to dig up some bananas and drive them about an hour and a half to my home and plant them. Technically, that could violate "moving" a plant. What if someone ships a small banana to a friend? Is that prohibited, even if it wasn't sold? Does every person on here who sends a cutting or a plant or a seed to another person have a license/permit? Or is it mainly selling plants in a commercial capacity(advertising and selling a lot?).

I don't know the regulations in Florida but in the same situation in California both would be in violation of law. When you buy a plant at a nursery or even Home Depot, they already have the license and required inspections that permit you to transport the plant. Some states have free licenses for small scale activities but still require a license even if it's not commercial. One small backyard grower in SoCal was found to have citrus greening disease (HLB) because of an illegal movement and now many millions are being spent to attempt to stop the spread of this serious disease. What may have seem like a small little harmless activity created a huge problem.

Laws vary by state, but most require a nursery license to sell plants anywhere, including at the farmers' market.

There are no special requirements for listing plants you have available here. This is a forum and moderators may intervene if we have reason to suspect someone is defrauding others but that's about it. Visit the forum rules (see quick links tab at top) for further details.
