That shooting happened in 2009, and I'm not aware of current status of the shooter but I wouldn't be surprised if he's in jail now.

The Law doesn't allow you to just shoot a thief or a shoplifter.

I have a neighbor plantain farmer that shot and killed a thief and he's still in jail.

One person is dead and the other is in jail, all over a few plantains, not a good solution.

If you're going to steal someone else's property you better be prepared to face the consequences! Just look at it like this, if there was no theft then there would be no injuries or a person in jail.

I don't understand why the innocent person defending his property here is the bad guy?

I think that the isolation of the larger farm and the fact that it's difficult to access plays a role in the limited troubles that I have with theft. For the farm behind my house, the reasonable expectation of being shot prevents theft.

To access my main farm you have to have a 4 wheel drive pick up truck in order to get over the railroad since there are no crossings. The entrance is locked. I have a friend that grows mangos next to a residential area and he has constant trouble with thieves. My fellow banana farmer in Belle Glade gets his fruit stolen on a regular basis as well. The other thing is that thieves in my area tend to be deathly afraid of spiders.

The Golden Orb Weaver...AKA the banana spider. It's not poisonous, it's just big and scary looking. You probably won't have much trouble with them up in St. Augustine. There is a gigantic population of them where I grow.

It's difficult to believe Florida Law really allows you to shoot someone for stealing fruit.

If so, then you can shoot anyone who is on your property and just toss a few oranges near the body.

Something doesn't seem completely accurate about this.

I had a Jamaican Domino Club in Miami that was almost robbed by a Haitian.

Before he made it to the counter, he had 2 to 3 dozen guns pointed at him, but nobody shot him.

Florida has the castle doctrine, and pretty much if someone is on your property and you warn them, and they don't leave open fire. It's pretty much the wild west. Not that I would shoot anyone, but there is a reasonable fear. Some of the other growers will unload a clip over their grove every once in a while just to let it be known.

Thanks for the name of the Law, I'm interested in reading it.

I still can't comprehend how you can prove you warned someone before you killed them.

In Puerto Rico it is against the Law to even fire a gun anywhere other than at a range.

Florida should consider a 5 Strike Law, first offense - lose a hand, after your out of hands and feet then lose your life.

Statutes & Constitution :View Statutes : Online Sunshine

It is not legal for a person to protect their fruit with deadly force in Florida.

This next link will get you to the Law in each State.

You Can Use Force To Eject The Subject From Your property , Only Not Deadly Force , Unless The Situation Turns Into A Forcable Felony , Then You Can Shoot.

Basically You can beat the perp Into a pulp without killing him if he or she enters your property To Steal Fruits , Or Anything Else In Your Property.

Yea, FL is sounding better all the time! Arms usually stop crooks and punks without injury. Not to shoot someone just to shoot 'em but let know you mean business. Besides, thievery is against all laws and the good word.
