Ok, well aside from bananas not being trees, you are visibly asking for someone in the US to break both US and AU phytosanitary laws and ship to you. The authorities at both ends will be watching.

Under the Australian Quarantine act the buyer assumes all culpability; there is in fact no risk to the sender/seller whatsoever. None.

If what I try to import is seized, it will be destroyed. There is an extremely remote possibility that I might incur a small fine, what is extremely more likely is that I'll get a good tut-tutting from ICON in the form of a letter.

I buy things from the US all the time without incident; the reality is, packages from the US are almost never even opened. Portugal/anywhere in south America, then yes. The US/Europe--No. I have never had a package destroyed incoming from any of those locales. However, this time I'm looking for something specific which will require somebody actually present in the US to purchase on my behalf.

You are an incredibly milquetoast human being if you do generally believe that big brother has the resources, time, energy and inclination to care about a Hobby grower importing a fruit tree for personal use, let alone to get into a protracted legal battle over it. It might be time for a new tinfoil hat.

What you wrote is fairly obvious, and the receiver which you correctly did not specify might not even be aware of the contents of every given package.

Although, I do like the Australian Quarantine Act.

It's all about money. I once bought 2 Encephalartos plants in South Africa. They came with a phyto certificate for wich i had to pay ofcourse. Then i had to pay for the Dutch import permit. I emailed the import permit to South Africa and they shipped the plants with the Phyto certificate and a copy of the import permit to Holland. The customs in Holland intercepted the plants and had them inspected once again by their phytosanitary institute. Of course they charged me alot of money for this. So in the end i had paid twice for a phyto inspection!

So they punish you for doing it all legal and i guess this and all the paperwork and costs involved makes that people just take the risk of losing the plants and they accept the fact that if they are unlucky they wil receive a small fine.
