We have lived in our house since last Febuary. Next door neighbor has become a problem after a few months of living here. It's a beautiful HOA subdivision mind you.
We had to put a lock on our fence so he didn't nose around. They would send their little boy to play with my kids. That was okay for a few times. He is to young for my kids. After second time kids playing together mine said he showed them his private area. Kinda ODD. Plus my kids don't like the smoking and drinking as well their son told us he doesn't either.
After several times they got the hint.
So then Cigarettes,dog poop,wrappers started showing up in our yard. Caught him riding his motorcycle,dirt bike,four wheeler up our driveway driving through our yard to his. I was nice and said please stop. He grunted back.
Then the reving up of motorcycles,dirt bike,fourwheelers on the side of our house has gotten out of hand.
Had a party in April and they put a cigarette in our mailbox and sprayed my banana plants on side of house near his. Him and friends were standing on side of the houses. Some type of starter fluid or something with high alcohol content.
I played dumb about it and asked him if he had any idea about this stuff. Course he didn't.
Then I would find wrappers thrown over the fence in the backyard.
Most recent he used a pump sprayer you use for weeds with, wood stain on his fence spraying it all over the place. I went out and said hey man that stuff is flying on the house,banana plants. He ignored me and repeated myself and he said no it's not and cussed me out.
I left to sell some banana plants. My wife said check the side of the house he really sprayed it I heard it. All over the place and did the roof and side of my greenhouse. We took pictures and video. Then he threw a rat into our yard he hit with his mower. Which have shown up since he feeds his poor dogs outside they never care for.
So police came out,filed report and sent him a letter for court. Went yesterday, he said I want a attorney. So now we wait till Sept 18.
A source told me the Sheriff's office has been investigating him for awhile. Something illegal he's doing at work.
Mind you he is in his upper forties pretty sad to act like this. Just because we don't want our kid playing with yours. Tons of kids in the neighborhood... No one else seems to fond of him. HOA has gotten complaints about him several times.
My question is do we say screw it and start looking for another home? It's been quite since we served him papers. I have no problem taking him to court again if need be. We worry when we aren't home are they messing with stuff.. Before anyone says beat him. Trust me if I wasn't a mature adult and man of Christ I would. I can't afford being sued,jail time,loosing my job. I have a family to care for.
What are everyone's thoughts?

History has a tendency to repeat itself... The legal and peaceful way would be to move if you can afford to... You don't need that kind of stress in your life. Easier that way. But hey, I'm not that attached to a place in particular. That's the best advise I can give you. I can tell you one thing though, there's things you shouldn't discuss on the net or on the phone... Don't get me wrong, I do hold my ground but prefer to avoid conflict when possible. Especially when you've got wife and kids... HOA should definitively take care of this problem...

put up some video surveillance cameras all round your house, if he keeps acting stupid least you will have proof of it.

WOW! After reading that I will NEVER complain about MY neighbors again! :)
I'm so sorry. I agree with others to either move or, more realistically, put up cameras. This is so sad.

Stand your ground! Camera's are cheaper then moving. Just remember, you need a camera facing every camera. Leave no dead spots. This is the type of guy who will look for holes in your system. Trying hanging fishing line from tree to tree in the area where they are riding the dirt bike. It will throw them off when they hit the wire. When they complain, remind them, this is my property and I had those hanging for my vine plants to grow on. I use used fishing line in the past for green beans.

What I would do would depend on whether or not both of you own your houses. If neither of you own or he does, I'd probably move. If you do and he doesn't, I'd wait out the legal process, make sure the HOA is aware of your current problems (keep them apprised of any new assaults on your peaceful living) and install cameras. I would be very careful about booby trapping your driveway; that can backfire badly even though you are in the right.

Thanks guys. No issues posting this as it was in the police blotter in the local paper.
He doesn't own it his wife's father does and she gets full ownership when he would pass.
HOA won't do anything unless his grass isn't cut or trash cans are laying around. HOA is always a joke.
Not sure they would allow cameras on the house.
By December if things aren't better we are going to look for somewhere else.
Kinda hate to make them to force us to go somewhere else as that's not right.
But if it's to the point we hate being outside if they are then moving in the long run be worth it. No else in the neighborhood is like him. Everyone waves and is friendly.

I think you're on the right track. Sometimes it's easier to move as it will probably be a faster and less stressfull in the long term... I've been there! I feel your pain. This could last for years and I bet you'd prefer moving on asap... The laws protect the *******s these days... Good luck and don't forget to move your nanners with you!!!

I told a lady to stay out of my recycle bin and when I left for work someone put 5 lbs of dog poop over my fence. My fence was locked so they couldn't get it to my front door. I put up surveillance camera's and haven't had any more problems.

My friend got a camera system through his cell phone provider. He gets an email and a video clip when someone triggers the motion sensor at his front door. He can turn lights on an off from his cell phone. I wouldn't let someone chase me away from my house. Good luck with this crazy person.

Man that's crazy as well! What's sad is there is at least six policeman in the neighborhood. One is my neighbor and him and his wife are great. But he is not proactive. He said more less in nice words he didn't want to get invoked.

That's too bad. Neighbors should stick together. I'm lucky I have great neighbors who watch my house when I'm away and do not hesitate to call the police if needed.

I would tell them about all my problems? What would they do threaten him with fines.
