Hello everyone,
I don't know if this section is right for this post
however last july I ordered from florida hill nursery 3 plants of banana (2 veinte cohol and 1 siam ruby)
I went in the website and I chose the plants ...... I payed but never this nursery sent me these plants and never I have received an answer to the many mail
someone had never some problem with this nursery ?
what I must to do for resolve it ?
they don't answer at email ....I write the situation in them ebay and their answer is the policy of ebay don't permits to speak of websites

Would you mind sharing the item number of your order and also the seller's auction name ? I'd like to look at the nursery store for a few things and maybe I can help you out. In the past I had an Ebay store and have had many transaction buying and selling there.

I found their store and although there feedback seems to look good with a 99.9%, this is calculated over the last 12 months and does not take earlier transaction into consideration. When a seller has a 99.9, always check there total transactions and click on any neutral and negative feedback to see what exactly the issues were. I will not purchase any item from any seller on Ebay who has less than a 99% positive feedback and must have hundreds of sales which tells me he is not new to Ebay. In other words, a seller who has 100% positive feedback and only two transactions tells me they are new to Ebay and if high dollar item I'm looking for, I will search for anther seller with more total transactions.
I would continue to report the issue to Ebay but at some point I would have to weigh my time and cost of lose and frustration and chalk it up as lesson learned and be sure to fill out the feedback for that seller and maybe it will steer others in another direction and not have to go through the same.

but since that I haven't received any answer to my mail after I have contacted their Shop on ebay

but for the first time they made a response saying that in ebay it's impossible to speak about website
And I reply another time saying that so give me a mail where you can answer me or give me an answer to my mail which I sent
and after nothing .... no more answer and kept my money without reason

The above may be true if the seller doesn't have a phone number listed in their profile. Have you searched for the number or tried to look it up in the White Pages(Directory). I'm not sure I understand one statement you made and that is it's impossible to speak with website.

i check in the website but there isn't telephone number
i ordered at the end of july in order to have plants in new york because I could receive at that moment
I'm italian and now I cannot receive here for custom

I just received a Pink Velvet banana plant from them a couple of days ago, it looks pretty good, packed good, pretty healthy. Didn't come in the pot, it was bareroot and had a perfectly egg shaped soil ball over the roots that didn't break apart and just dropped into the soil. Don't know how they did that but whoever packed the soil was a artist.

If you paid via credit card, report it to them. Florida Hill has a FL license; they are subject to regulations. It is fraud to take money without shipping goods; you can report your situation here Florida Attorney General - Home Page (http://myfloridalegal.com/) (If others would report such thefts, it would help future victims.)

I assume your order has still not been received. If so, please complain to the Attorney General. It may do nothing but not only does this company have a business license in FL but a nursery license. They won't pay attention to you? Bet they will pay attention to the government because they dare not.
I'll go one step further. IF you told them that the order had to be in New York by the 24th and it wasn't, then there's another USA legal issue in play--Uniform Commercial Code that is upheld in all our States--your offer was at some point contingent on timing and it didn't happen. Thus the contract was void and your funds should have been returned.
Please, please report this. If you need help, I'll try as will others here I'm sure. I know you'd rather have your plants home with you in Italy but, since that didn't happen, you should have a refund.
