Yes, even a hobbyist is required to comply with Federal and state regulations in the USA to help prevent the spread of insect and disease pests.

Where does one get a nursery license? Do you call your state agriculture department? Do you really need a license if you sell a plant or two a year? Im not on eBay… Yet but I’ve thought about making a little money in my hobby to buy other bananas.

Anyone know if I need one in Canada too if I only sell the odd pup that I have too many of? I'm assuming so but would probably not use eBay, just kijiji (like Craig's list).

In case it's not apparent, Tony's point of posting this article here about Asian Citrus Psyllid is that this pest arrived to California via illegally imported citrus trees and the huanglongbing arrived via illegally imported citrus trees as well (we had ACP here well before a single diseased specimen was found earlier this year). Most nursery citrus trees are already made entirely in screened grow houses ahead of regulations which require this (effective in January 2013, I believe).

Just to be clear, the rules seem to say that "moving" plants requires a permit, but does that refer to selling them or physically moving them? I would think that if every person needed a permit to physically move a plant, no one could buy any plant to transport it home, right?
I mean, I'm supposed to dig up some bananas and drive them about an hour and a half to my home and plant them. Technically, that could violate "moving" a plant. What if someone ships a small banana to a friend? Is that prohibited, even if it wasn't sold? Does every person on here who sends a cutting or a plant or a seed to another person have a license/permit? Or is it mainly selling plants in a commercial capacity(advertising and selling a lot?).

I don't know the regulations in Florida but in the same situation in California both would be in violation of law. When you buy a plant at a nursery or even Home Depot, they already have the license and required inspections that permit you to transport the plant. Some states have free licenses for small scale activities but still require a license even if it's not commercial. One small backyard grower in SoCal was found to have citrus greening disease (HLB) because of an illegal movement and now many millions are being spent to attempt to stop the spread of this serious disease. What may have seem like a small little harmless activity created a huge problem.

Laws vary by state, but most require a nursery license to sell plants anywhere, including at the farmers' market.
There are no special requirements for listing plants you have available here. This is a forum and moderators may intervene if we have reason to suspect someone is defrauding others but that's about it. Visit the forum rules (see quick links tab at top) for further details.

I looked into getting my nursery license for selling plants grown on my property and it's pretty serious business. In Florida, general nursery license varies based on the amount of plants you plan to sell. You get assigned a Department of Ag Inspector that works with you to understand all the rules and also inspects your property twice a year.
You also need to comply with the Imported Fire Ant quarantine if you want to ship to most of the southeast US. Prices go up if you want to sell to LA, AZ, TX, CA & HI since they have heavier restrictions of what's coming into their states and require additional testing of your plant & planting material.

I found the process of applying and inspections to be very simple. We have had our nursery license in Florida since 1998 - for shipping plants sold on our website and selling to a few individuals locally. The nice part is edibles (including banana plants) are not subject to sales tax in Florida.

Yes, I agree the process is pretty cut and dry. My point was that many backyard growers have no idea that these regulations are in place, even for a hobby grower selling 1 or 2 plants a month.
Tell me more about the sales tax. Is that only edible plants sold within Florida?

Now they've added TX and LA? Sheesh. I wonder how many hobbyists and other "unregulated" businesses fly under the radar and pay no attention to rules that prevent unwanted pests and diseases from entering another area? BTW, I put a Cuban frog in the freezer this morning because that's how FL wants me to dispatch these creatures. (I suppose that I could have had it for dinner and that would have been okay but, blech, no.)
I've read the rules and spoken with a few people who hold licenses; they don't find the rules/inspections terribly onerous. If you have much of a business, you're more likely to run into problems selling from your residential property.
BTW, food is not taxed in FL. There's some debate about whether seeds or plants that can produce food should be taxed. Personally I don't think tax should be charged but you can get clarification from Tallahassee.

Since this thread was revived - I will clarify what we were told about sales tax in Florida. I called the FLDOR (FL Dept of Revenue) about this earlier this year after a customer told me I needed to have a written letter from each customer stating they were going to use the plant for food in order to avoid collecting/paying sales tax. The FLDOR said if we only sell edibles and not ornamentals - then we do not need to collect/pay sales tax on anything. If we were to sell fertilizer for fruit trees, that also would not be taxable. We were also told fruit trees and vegetable/herb seeds and plants should not be taxable within the state of Florida even if sold at establishments which also sell other items which are taxable.
I called a sales tax attorney for additional confirmation and was told the same thing. Hope that helps!
