Would I need a nursery license to legally sell plants to other members here?

Not really. I have had a license for three years. To ship to certain areas of CA. and to most any States I have to have these traps monitored for 6 weeks.:08:

Richard or Harvey can answer that better than me.

The regulations on CDFA's site can be found by going to NIPM 2 at Nursery Inspection Procedures Manual (http://www.cdfa.ca.gov/plant/pe/Nursery/NIPM.html) which I think are a little bit clearer (?). One important thing is to make sure to read everything on the citrus page because there are other conditions which much exist for the $1,000 exemption to apply (i.e., notify your ag commissioner, all sales are within your own county).

In Florida, you are actually supposed to have your nursery inspected even if it is for your own use. It's cheap though.

I pay $150 for my license and haven't paid for any inspections. They have a trap for Light Brown Apple Moth and also take samples of hosts for Sudden Oak Death. There is some of each in the county but not very close to my place. The last time they did the SOD sampling it was a classic example of bureaucrats with three people coming in two vehicles, driving 10 miles past my place, calling for directions, and the having me tell them what they needed to take samples of. ;)

What I'm getting from this is that I would still have to get a license to sell bananas and other plants within my county, but I won't have to pay the license fee as long as these three conditions are met?

His sales of plants amount to less than one thousand dollars ($1000) within any one fiscal year.
He has reported to the commissioner his intention to make such sales.
All plants which are sold by him are of his own production, and are sold for planting within the county in which the plants were grown.

If that sticky trap was at my house this time of year it would be covered with insects.

I can ship some things to california, but not others with my Indiana nursery license. Bananas have to be barerooted, I have to have a copy of my dealers license in the box, and a note on the outside of the box with my nursery dealers license number, what kind of plants are inside, variety and latin name, and "all barerooted and carefully removed of all soil" on the box. I can't send peppers or tomatoes at all.

I saw my inspector come by while I was headed back from irrigating alfalfa this morning so I stopped to talk to her. They're trapping from Light Brown Apple Moth here and she said she's found 4 this year with the closest being about 10 miles downwind from my place.

Is that moth a big problem? We have an apple tree maybe we should spray it. We have enough trouble with those bluejays.
