You can assault someone without causing them actual harm. All that is required to have an assault is for you to threaten physical harm to someone or to cause them to feel physically threatened with an apparent capacity to carry out the threat.

Battery would be the offense involved with actually physically touching the person (or causing them to be touched).

In this case, pointing the firearm at the person would be an assault. Actually shooting him would be battery.

Below is Tennessee's criminal code on Assault and Aggravated assault. It is just about the same in all other states. Generically it’s - Intentionally causing another to fear an assault and used a deadly weapon to cause that fear.

According to Tennessee criminal law, a person commits assault when they:
• Intentionally, knowingly or recklessly causes bodily injury to another;
• Intentionally or knowingly causes another to reasonably fear imminent bodily injury; or
• Intentionally or knowingly causes physical contact with another and a reasonable person would regard the contact as extremely offensive or provocative. Tenn. Code Ann. § 39-13-101
an assault may become aggravated. A person commits aggravated assault when they:
• Intentionally or knowingly commit an assault as defined above and that assault:
(A) Causes serious bodily injury to another; or
(B) Uses or displays a deadly weapon. Tenn. Code Ann. § 39-13-102 (2007).
